Terms of Service

These Terms of Service (“Terms”) govern your use of the Key Capture mobile application (the “App”) developed and operated by Mobile Tech Media, LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Use of the App

Key Capture is a mobile application for Apple iPad and iPhone that allows you to overlay a real-time 88-key MIDI visualization on your device’s camera feed and stream or record piano performances. The App requires access to your device’s camera, microphone, and Bluetooth capabilities to function properly.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for all content you create, stream, or record using the App.

2. Account and Authentication

To stream to YouTube or Facebook, you must authenticate your account through Google OAuth or Facebook OAuth. You are responsible for maintaining the security of your connected accounts. We do not store your social media passwords.

3. Subscriptions and Payments

The App offers a free tier with a 5-minute session limit and paid subscription tiers (Monthly and Yearly) that unlock unlimited streaming and recording.

  • All subscriptions are managed through Apple’s App Store.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your Apple ID account settings.
  • Refund requests must be directed to Apple, as we do not directly process payments.

4. Intellectual Property

The App, including its design, code, features, graphics, and documentation, is the intellectual property of Mobile Tech Media, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

You retain all rights to content you create using the App (recordings, streams, etc.). By using the App, you grant us no rights to your content.

5. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the quality, reliability, or availability of any streaming connections facilitated by the App.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Mobile Tech Media, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the App
  • Any interruption to your streaming or recording sessions
  • Unauthorized access to or alteration of your transmissions or content
  • Any third-party service failures (YouTube, Facebook, RTMP servers)

7. Third-Party Services

The App integrates with third-party platforms including YouTube, Facebook, and custom RTMP servers. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the availability, performance, or policies of third-party services.

8. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

9. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days’ notice of any material changes by posting the updated Terms on the keycapture.app website. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.
